Terms & Conditions
By hiring from Dress Up Diaries, and accessing and using the Dress Up Diaries website at https://dressupdiaries.com you are accepting and consenting to the practices in these terms of use and our Privacy Policy (available at https://dressupdiaries.com). Dress Up Diaries reserves the right to change these terms and conditions from time to time at its sole discretion.
1. Definitions
- Items: Refers to the dresses, garments, and accessories hired from Dress Up Diaries.
- Hire Period: The duration for which the Items are hired, commencing on the date of delivery/collection and ending on the date of return, as specified in your booking confirmation.
- Hire Fee: The amount payable by you for the hire of the Items, as detailed in your booking.
- Security Bond/Deposit: An amount paid by you to cover potential damages, loss, or late return of the Items.
- Australian Consumer Law (ACL): Refers to Schedule 2 of the Competition and Consumer Act 2010 (Cth).
2. Booking and Payment
2.1 Booking Confirmation: Your booking is confirmed upon receipt of full payment of the Hire Fee (and any applicable Security Bond/Deposit) and our confirmation email.
2.2 Payment: All payments must be made in AUD. We accept payment methods via credit card or bank transfer (if in person) only.
2.3 Pricing: All prices are as displayed on our website/in-store and are subject to change without prior notice. The price confirmed at the time of booking will be honoured.
2.4 Cancellation by Hirer:
a. Cancellations made 3 or more days/72 hours before the start of the Hire Period will receive a 100% refund or store credit. Cancellations after 72 hours of the Hire Period will forfeit the Hire Fee.
b. This cancellation fee applies to all customers who have consented to these terms and conditions.
2.5 Cancellation by Dress Up Diaries: In the unlikely event that we must cancel your booking (e.g., due to unforeseen damage to the Item, or unavailability), we will notify you immediately and offer a full refund or an alternative Item of equal value, subject to your approval.
2.6 Minimum Hire Period: Minimum hire period is 24hrs.
2.7 Security Bond/Deposit:
- Please note a REFUNDABLE bond applies to all our dresses due to the cost of repair or replacement if there is any damage to the items.
- This bond is charged in addition to the rental fee and will be refunded within 48hrs of return, provided the item is returned on time and in undamaged condition.
- We reserve the right to retain all or part of the Security Bond/Deposit to cover:
- Late return fees.
- Costs associated with significant damage or stains.
- Replacement cost for lost or stolen Items.
3. Hire Period and Return
3.1 Commencement of Hire Period: The Hire Period commences on the date the Item is collected by you.
3.2 End of Hire Period and Return: The Item must be returned to us by [time] on the last day of your Hire Period.
3.3 Return Method: Items are to be returned via our mailbox drop box outside of the address given to you to pick up and drop off the dresses. You will have a set time you are able to hold the item (usually 24hrs) which will be confirmed in person and in your terms and conditions after full payment for dress is received.
3.4 Late Returns: A late fee of $50 per day will be charged for each day the Item is not returned after the agreed Hire Period. This fee will be deducted from your card on file or, if it has exceeded a certain number of days and there has been no point of contact from you (the customer), we will deduct full payment of the dress from your card on file and the dress will be noted as “lost”.
3.5 Condition of Item on Return: The Item must be returned in the condition it was provided to you, fair wear and tear excepted. You must not attempt to clean or repair the Item yourself.
4. Care of Items and Damages
4.1 Your Responsibility: You are responsible for the care of the Item from the moment it leaves our possession until it is returned to us.
4.2 Prohibited Actions: You agree not to:
- Alter, cut, or modify the Item in any way.
- Attempt to clean or repair the Item.
- Expose the Item to harsh chemicals, excessive sunlight, or extreme conditions that may cause damage.
- Allow others to wear the Item without our express permission.
4.3 Damage, Stains, or Loss:
- You must immediately notify us of any damage, significant stains, or loss of the Item during your Hire Period.
- Minor Damage/Stains: We understand that minor wear and tear may occur. Minor, easily repairable damage or small, removable stains may be covered by the Hire Fee.
- Significant Damage/Stains: For significant damage (e.g., irreparable tears, burns, excessive or permanent staining) or if the Item is lost or stolen, you will be liable for the full retail value of the Item at the time of hire, in addition to the Hire Fee. This amount will be deducted from your Security Bond/Deposit, and if insufficient, you agree to pay the remaining balance. We reserve the right to determine what constitutes minor or significant damage/stains.
- Theft/Loss: In the event of theft or loss, you must provide a report within 24 hours of discovering the theft/loss. Failure to do so may result in full liability for the retail value of the Item.
4.4 Cleaning: All Items are professionally cleaned after each hire. The Hire Fee includes standard dry-cleaning costs. You must not attempt to clean the Item yourself.
4.5 Fake Tan Warning:
- Customers planning to use fake tan must take all necessary measures to avoid staining the dress (e.g., wearing a barrier garment, ensuring tan is fully developed and set before wearing).
- If fake tan staining occurs and professional cleaning is required, the customer’s card will be charged a cleaning fee.
- Permanent staining may result in a full replacement charge.
5. Consumer Guarantees (Australian Consumer Law)
5.1 Application: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
5.2 Acceptable Quality: The Items we supply will be of acceptable quality, fit for the purpose for which they are commonly supplied, and match the description provided.
5.3 Fit for Purpose: If you advise us of a particular purpose for which you are hiring the Item, and we agree that the Item is suitable for that purpose, it will be reasonably fit for that purpose.
5.4 Remedies for Faulty Items:
- If there is a minor problem with an Item, we may choose to offer a repair, replacement, or partial refund.
- If there is a major problem with an Item (e.g., it is unsafe, significantly different from the description, or unfit for its intended purpose and cannot be easily remedied), you are entitled to a refund or a replacement.
- You must notify us of any issues with the Item immediately upon receipt or discovery.
- This is only subject to if the item has been thoroughly looked at before leaving the store, confirming payment and agreeing to our terms and conditions.
6. Limitation of Liability
To the extent permitted by law, our liability for any loss or damage suffered by you in connection with the hire of an Item is limited to the Hire Fee paid by you.
We are not liable for any indirect or consequential loss or damage, including but not limited to loss of enjoyment or special event costs, arising from the hire or use of the Items.
We take all reasonable care to ensure Items are provided in good condition, but we do not guarantee that the Item will fit perfectly or be suitable for every individual's comfort or style preferences. We recommend trying on the Item where possible or reviewing size guides carefully.
7. Privacy Policy
We collect personal information necessary to process your booking and to manage our business operations (e.g., name, contact details, address, payment information).
Your personal information will be handled in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

We use secure payment gateways and do not store sensitive credit card details.
8. Intellectual Property
All intellectual property rights in our website content, branding, and original designs (if applicable) belong to Dress Up Diaries or our licensors.
You must not reproduce, distribute, or use any of our intellectual property without our express written permission.
9. Dispute Resolution
If you have a complaint or dispute regarding our services or an Item, please contact us immediately at contact@dressupdiaries.com.
We will endeavour to resolve your complaint promptly and fairly through our internal dispute resolution process.
If we are unable to resolve the dispute to your satisfaction, you may refer the matter to Consumer Affairs Victoria (for Victorian residents) or the Australian Competition and Consumer Commission (ACCC). These bodies can provide information and assistance with consumer disputes.
10. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Dress Up Diaries concerning the hire of Items.
- Amendments: We reserve the right to amend these terms at any time. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms periodically.
- Governing Law: These terms are governed by the laws of Victoria, Australia, and the Commonwealth of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.
- Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Force Majeure: We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by events beyond our reasonable control.
11. Victorian Consumer Guidelines – Closing Statement
This agreement is made in accordance with Consumer Affairs Victoria guidelines for rental businesses. Under the Australian Consumer Law (ACL), you have rights to goods and services that are provided with due care, are fit for purpose, and as described.
By hiring from Dress Up Diaries, you acknowledge and accept all the above terms and agree that:
- You have read and understood the full terms & conditions.
- You authorise Dress Up Diaries to charge your nominated payment method in accordance with these terms.
- You are bound by Victorian jurisdiction in any legal matters arising from this agreement.
